A Calgary couple accused of manslaughter in the death of their grandson last year were back in court on Thursday.

Allan Perdomo Lopez, 56, and Carolina Perdomo, 49, were charged in the death of Eneas Emilio Perdomo after new medical evidence led police to deem the boy’s death a homicide.

Emilio was taken to Alberta Children’s Hospital on July 10, 2015 and medical staff noticed swelling and bruising that were not consistent with the normal activities of a five-year old.

The little boy died in hospital and an autopsy determined that he died from blunt force trauma.

Allan Perdomo Lopez is the boy’s biological grandfather and police say Emilio was sent to live with him by his mother in Mexico so that he could have a better life.

The couple appeared before a judge on Monday but the case was put over to allow their lawyers time to review the file.

On Thursday, a bail hearing was set for next Wednesday and lawyers for the couple say they should be released if prosecutors can't provide evidence as to why they should remain in custody.

“In this particular case the Crown has to show cause why detention is warranted and potentially they could do that on Wednesday but in the meantime, I’m going to propose a release plan to the Crown and hopefully the conditions will be sufficient that they feel that the Perdomos can continue to prepare for their trial while not in custody,” said Allan’s lawyer Darren Mahoney.

Mahoney says he will present the plan to the Crown over the weekend and he is confident that the couple will be released.
