A Calgary soldier has won his appeal after being convicted of negligence for a fatal training accident in Afghanistan.

The Court Martial Appeal Court of Canada overturned Lieutenant Darryl Watts's conviction for negligent performance of duty, and ordered new trials on charges of unlawfully causing bodily harm and a second count of negligent performance of duty.

Watts was in charge of the training range when an anti-personnel mine misfired in February of 2010.    

Cpl. Josh Baker was killed and four other soldiers were injured when a C-19 Claymore anti-personnel mine misfired.

Watts was demoted to lieutenant from major and given a severe reprimand.
