The City of Calgary has laid charges under the Safety Codes Act of Alberta against five companies related to the negligent repair of a parkade in a downtown condominium building.

In June of 2011, resurfacing began on the second level of the Rocky Mountain Court parkade in the 200 block of 6 Ave. S.E.

The parkade floor suffered damage, compromising the structural integrity of the building. 

A city of Calgary investigation determined areas of the building to be unsafe prompting the closure of levels 1, 2 and 3 of the parkade and seven businesses on the ground level of the complex.

Charges have been laid against:

  • The condominium owners of Rocky Mountain Court
  • Maverick Condominium Property Management
  • Williams Engineering
  • Durwest Construction Systems
  • Champion Concrete Cutting

The Charges laid include:·  

  • Causing damage to the second floor of the parkade of Rocky Mountain Court during renovations
  • Failure to notify the businesses, employees and the public beneath the compromised parkade
  • Failure to notify the authorities
  • Failure to ensure the structure which was damaged was properly supported underneath to prevent collapse
  • Failure to obtain the proper permits prior to commencing work (2)
  • Failure to prevent the public from accessing the parkade and businesses after structural damaged occurred.

“We are extremely disappointed that such a routine renovation went so wrong,” says Kevin Griffiths, manager Building Regulations and Chief Building Official for The City of Calgary. “From the start, public safety was disregarded and that is unacceptable. The City will continue to take legal action where unsafe conditions exist.”
