Alberta Justice has released a report on the fatality inquiry into the death of a Calgary man who was shot by police back in 2009.

Melvin Donald VanHouwe, 49, of Calgary died after he pointed a gun at a member of the Calgary Police Service and was shot multiple times.

Police were called to a home in the 500 block of Sabrina Road S.W. on May 24, 2009 for a weapons complaint.

When they arrived a hostage situation was developing at the home and VanHouwe was holding his neighbour, Devin Gillingham at gun point in the backyard.

Police ordered VanHouwe to drop his weapon but he pointed the sawed-off shotgun at police instead and was shot by a Tact Team member.

VanHouwe was transported to Foothills Medical Centre in critical condition but later died from his injuries.

An autopsy confirmed he died from multiple gunshot wounds.

The fatality inquiry agreed on the cause of death and the officer who shot Vanhouwe testified that he fired three shots from his C8 Colt sub-machine gun at the suspect.

At the time of the incident, VanHouwe was under a 10 year weapons ban that was issued in 2003.

The inquiry determined that police did not breach policy or procedure and that the outcome was the result of VanHouwe’s actions that night.

The inquiry did not make any recommendations on how the death might have been avoided.
