A Calgary judge presiding over the case of a cab driver accused of killing a teenager last year has reserved his ruling for a later date.

The court heard closing arguments from lawyers on Friday morning, after which the judge informed the court he needed more time to determine whether or not Maguder knowingly drove away to avoid criminal and civil liability associated with the incident.

Stanislaw Maguder, 71, was charged with the hit and run death of 16-year-old Tyla Rain Rose Chipaway in March 2015.

Police say that in the early morning hours of March 18, a body was found in the middle of the road by area residents.

EMS attended and declared the victim dead at the scene. The investigation showed that the injuries inflicted were consistent with being struck by a car.

CCTV footage recorded before the incident showed the victim walking back and forth, in and out of traffic on 16 Avenue.

A toxicology report showed that Chipaway’s blood alcohol reading was 0.21, more than double the legal driving limit.

Maguder was arrested a few hours later and charged with the hit and run.

Earlier this week, the accused admitted to the court that he did run over the girl, but he didn’t know what he’d done.

Maguder testified that he thought he’d run over some luggage or something else that had fallen from someone else’s car.

His lawyer, Balfour Der says that a video of Maguder immediately following the crash, which was taken into evidence, showed that his client could not piece together what he’d done and therefore he could not have had any criminal intent.

Crown prosecutor Elaine Awn disputed the defence, saying that Maguder committed 25 traffic violations as he drove away from the scene of the crash.

Awn also told the court that Maguder was seen on video muttering the phrase, ‘I do not admit guilt’ over and over, indicating that he did know what happened.

The judge will make a ruling in the case on July 15.

If convicted, Maguder could face a life sentence.
