Shelby Herchak has pleaded guilty to manslaughter in the death of her 26-day-old son, Daniel.
According to the agreed statement of facts from court - the baby was “fine” up until 3:30 A.M. on August 8th, 2010, that’s when Herchak called 911.
Herchak told doctors the baby was fussy, she changed him, and he went "limp"
He was rushed to hospital with laboured breathing and Herchak was told his only chance of survival was surgery to remove the left half of baby's skull to relieve pressure.
Despite the surgery the baby died the next day.
The pathologist’s report says Daniel had swelling and bruising on his brain consistent with a fall or significant force.
Herchak was 18 years old when her baby Daniel died.
