The Calgary man who stabbed his neighbour to death back in 2013 is appealing his conviction and sentence, which was handed down last week.

Nicholas Rasberry stabbed Craig Kelloway, a Calgary teacher, 37 times after he said Kelloway threatened to sexually assault him and his wife following a long drinking session in May 2013.

In the appeal, his lawyers say the presiding judge made mistakes in the application of the self-defence legislation and that a victim of sexual assault should restrain themselves in how they respond to their attacker.

Rasberry was given a seven year sentence for his manslaughter conviction last week.

The Crown has already appealed his conviction, and is seeking a conviction for second degree murder.
