Charges have officially been upgraded for three people accused of randomly attacking and beating John Herrera to death.

Jarod Henry and Chantelle Campbell made brief appearances in front of the judge.  For both of the accused, charges of attempted murder were dropped and replaced with second degree murder charges.

In May, Herrera was severely beaten in a Beltline attack as he headed home for buying groceries.  

Herrera remained in a coma until last week when he succumbed to his injuries. The lawyer for one of the three accused, Chantelle Campbell, says his client expected the new charge.

A preliminary hearing is set for October for all three accused.  If that hearing determines there is enough evidence to proceed to trial, all three will be tried together by judge and jury.
