The man accused of killing Calgary teacher, Craig Kelloway, during an altercation in an Auburn Bay area home back in 2013 was sentenced in a Calgary courtroom on Friday.

Nicholas Rasberry and Craig Kelloway were drinking together at Rasberry’s home when an altercation ensued and Kelloway was fatally stabbed.

Raspberry was charged in Kelloway’s death and was found guilty of manslaughter earlier this month.

During the trial, court heard that Rasberry stabbed Kelloway 37 times and that three knives were removed from the scene.

Rasberry admitted to stabbing Kelloway but claimed it was in self defence and that Kelloway had threatened to have sex with him and rape his wife, who was sleeping in an upstairs room.

"He was grabbed, throttled and told he was going to be raped by a stronger man. I don't think, and any of you here, if you were in that position you would distinguish between where are we at in terms of a threat and I don't think too many people would do what the officer said, that she would run out and seek help down the street and leave a wife upstairs," said Defence attorney Hersh Wolch.

Justice Robert Hall rejected the claim that Rasberry acted in self defence but did find he had been provoked.

The Crown was asking for 15 years in the case and the defence argued that Rasberry had spent 13 months in custody before being granted bail and that he should not have to spent any more time in custody.

Justice Hall acknowledged the fact that Rasberry called 911 and cooperated with police but said it’s "important to denounce the greatly excessive force.”

On Friday, Rasberry was sentenced to seven years but will spend just over five years in jail, which includes 20 months credit for time served.

The Crown has appealed the manslaughter conviction and the defence says it will likely file an appeal in the case as well.

“It had a negative effect on everything. I expect we’ll be instructed to appeal the conviction and we do feel that there are some really important issues here,” said Wolch. “When someone has an attempted rape on them and an attempted rape on their wife coming up in their own home, how far can you go to defend yourself?”

Following his sentencing, Rasberry also made his first court appearance in relation to breaching his bail conditions. That case was set over until December 18, 2015.
