Calgary police say charges are pending against one man in connection to a hit and run that killed a 35-year-old gas station attendant on the weekend.

Maryam Rashidi Ashtiani died from her injuries in hospital on Tuesday after she was hit by a truck while trying to stop a gas-and-dash at a Centex station on 16th Avenue N.W. on Sunday.

Police released descriptions of two suspects and recovered the truck on a northwest street on Monday.

The vehicle was stolen in Airdrie and is currently being examined for forensic and mechanical evidence.

“Absolutely a tragedy. She put her life obviously out there, her life was taken and she saw something that was wrong, someone breaking the law, or individuals, and she was trying to prevent a continuation of that or stop them and who knows what would have happened if she didn’t but she took it upon herself for whatever reason we'll never know because we’ll never have a chance to talk to her unfortunately and basically went and tried to stop this vehicle and by doing that she put herself in grave danger, trying to prevent this crime,” said CPS Inspector Ken Thrower.

Police say the alleged offenders made off with $113.23 worth of gas.

On Tuesday evening, police received a number of tips from the public and surrounded a home in the Beddington area for several hours.

One person of interest in the case was taken into custody without incident at about 8:00 p.m. and a second surrendered to police at about 10:30 p.m.

“Had information that both suspects were at this house, the younger one came out early, right away, the second one stayed in the house until Calgary police set up outside with the Tactical Unit and a negotiator and with a blow horn they called him and he eventually came out,” said Inspector Thrower.

The Crown says no charges will be laid against a 16-year-old male who was identified as the passenger in the vehicle.

“At this time, with the Crown’s approval, no charges laid at this time but again, keep in mind the investigation is continuing so there could be some more developments in this, it all depends on what is uncovered,” said Thrower.

Police say charges against the driver, a 20-year-old male, are pending and that he will likely to be charged with:

  • Criminal negligence causing death
  • Hit and run causing death
  • Dangerous driving causing death
  • Possession of stolen property over $5000
  • Theft

Charges will not be laid until the accused has appeared before a Justice of the Peace and his name will not be released until after he has been charged.

Police say the accused is known to them and he could face a maximum life sentence for some of the charges.
