Nicholas Rasberry’s lawyer is seeking an acquittal while the Crown is looking for a murder conviction in the case.

He was convicted of manslaughter for killing his neighbour, Craig Kelloway, stabbing him 37 times in 2013.

Rasberry’s lawyer said he was acting in self-defense after Kelloway allegedly tried to sexually assault him and threatened to assault his wife who was sleeping upstairs.

The Crown is looking for a murder conviction saying the amount of force shows Rasberry chose to use lethal force.

The original trial judge found Rasberry was not acting in self-defense but also said he didn't feel there was the intent to kill.

Rasberry has been out on bail for nearly a year, and has more than five years left on his sentence.

The Court of Appeals has reserved its decision to a later date.
