Dr. Aubrey Levin, convicted of sexual assault and sentenced to five years behind bars, has been released on bail after serving just 13 nights in prison.

The former doctor was convicted in January following a four month long trial.

The judge in the trial said that he would have received an eight year sentence were it not for his advanced age and poor health.

His defence lawyers presented an appeal as soon as the sentence was handed down and they were granted interim bail while his appeal proceedings go on.

The Alberta Court of Appeal has yet to determine if it will grant a new trial for Levin.

Levin’s wife Erica has been charged with obstruction after she allegedly attempted to bribe a juror during the court case.

She is scheduled to appear in Calgary Provincial Court on Feb. 14.
