Two Calgary men who were found guilty in a mass shooting at the Bolsa restaurant on New Year’s Day in 2009 will be tried again.
The new trial for Michael Roberto and Nathan Zuccerato was granted on Wednesday because the prosecution’s star witness made a drunken confession to the RCMP in Saskatchewan.
They are both serving life sentences for the murders.
In it, the man known only as MM admitted to single-handedly committing the murders.
The jury who convicted Roberto and Zuccherato never heard the confession because it wasn’t disclosed until after the trial was over.
Sanjeev Mann and Aaron Bendle, both known gang members, were shot to death at the Bolsa Vietnamese Restaurant in eoutheast Calgary.
Keni Su’a, an innocent bystander, was also shot and killed.
A third man, Real Honorio, was also convicted in the deaths in March but his lawyer Greg Dunn says they will be seeking an application in the Court of Appeal rather than a mistrial.
A fourth accused, Nicholas Hovanesian pleaded guilty to accessory after the fact to murder and kidnapping in May 2012.
He was sentenced to 14 years in prison for his part in the murders, but will be serving just over six years in jail because of time served.
There is no information on when the new trial for Roberto and Zuccherato will be.
