The province’s top court has shot down an appeal from an Alberta woman convicted of manslaughter in the death of her husband back in 2010.

Heather Wilson-Duncan was convicted of killing her husband, 68-year-old Barry Duncan, on December 10,2010.

The couple got into an argument in their Didsbury area home and Wilson-Duncan claimed her husband handed her a gun and told her to shoot him.

Wilson-Duncan called 911 after the shooting and told the court during her trial that she hardly remembered making the call.

She said she didn’t know the gun was loaded and her lawyer maintained the whole incident was a tragic accident.

Wilson-Duncan was originally charged with second-degree murder and was found guilty of the lesser charge of manslaughter.

She was sentenced to four years in jail and appealed on the grounds that the trial judge made several errors.

The Alberta Court of Appeal unanimously disagreed and denied the appeal.
