Aset Magomadova, a Calgary mother who strangled her own daughter to death with a scarf, wants to have all charges against her dropped.

According to her lawyer, her health has bee failing for more than a year now and she is too sick to stand trial.

The upcoming trial will be her second.

At the conclusion of her first trial, she was convicted of manslaughter but the Crown appealed and won the right to try her again on a charge of second degree murder.

Her lawyer says she is undergoing regular chemo and radiation treatments and the trial had been reset to April. 15.

It will be up to the judge to grant the stay of charges.

The application will be heard next month.
