Tim Rempel, one of three people accused of murder in connection with the death of the father of his wife’s daughter, took to the stand on Tuesday where he recounted a meeting he had arranged with the victim in February 2012.

Rempel’s attorney, Allan Fay, said his client’s testimony was an attempt to answer more questions and fill in more blanks.

During his testimony, the 30-year-old said he met Sheena Cuthill at a pub in 2010 . The pair started dating two weeks after their initial meeting and, two weeks later, Cuthill and her daughter moved in with him.

Cuthill and Rempel married in 2011 and, according to Rempel, he expressed his desire to adopt Cuthill’s daughter but, in order to make that happen, she would need to have custody of the child. Custody of the young girl was being disputed by the child’s father, Ryan Lane.

Rempel said he discussed the custody issue with his brother Will at a family gathering and Will made a comment in regards to ‘making him go away’. Rempel says he didn’t take Will’s comment seriously.

Rempel said he suggested to his wife, Sheena Cuthill, that he should talk with Ryan Lane in an attempt to stop Lane from interfering in their lives and to back off on the custody battle. “I wanted to see him. I wanted to talk to him.”

In the early hours of February 6, 2012, Rempel sent his wife a text message asking for permission to talk to Lane. Rempel said he “got to my tipping point in wanting to see Ryan. There was a need for me to talk to him.”

Rempel testified that he didn’t believe Lane would talk to him so he asked Will to come along.  Rempel said he called Lane from a gas station pay phone and told him he had photos of Cuthill and his daughter that he would be interested in. Lane was provided with a location and description of a truck and told to get inside the vehicle.

Rempel told the courtroom that Will drove Lane to a road outside of Calgary shortly after midnight. Rempel met his brother and Lane at the location.

Rempel says he produced photos of Cuthill and her daughter in an attempt to show the life they now had. Rempel says Lane became emotional and shoved him, and Rempel responded by striking Lane with his left hand using “quite a bit” of force.

Rempel said he entered his Jeep and drove away from the area with his brother Will following in the truck. Rempel said the brothers left Ryan Lane alone, but alive, on the dark country road.

During his statement to police, Tim Rempel said he had never met Ryan Lane. When questioned under oath about his statement, Rempel said he lied to police because it would make him look bad.

Tim Rempel says he later questioned Will about what happened after they left. Rempel said he was told he “should not ask questions I didn’t want answers to”.

Rempel told the courtroom Will stated he had burned Ryan Lane’s body.

Members of the jury were asked to leave the courtroom following Tim Rempel’s testimony indicating his brother had admitted to burning Ryan Lane’s body. The jury later returned and was instructed to ignore Rempel’s testimony regarding the admission as it was considered hearsay and a potential issue.

Rempel’s testimony followed Sheena Cuthill’s time on the stand for cross examination. Cuthill said she was not part of a plan to kill Ryan Lane but there was a plan to make Lane walk away from the ongoing battle for custody of their daughter.

Tim Rempel, Will Rempel and Sheena Cuthill all face first degree murder charges in connection with Ryan Lane’s death.
